Welcome to Athenastarr (“Creator,” “we,” “our,” or “us”) and our website at https://shop.athenastarr.ca, provided through Fourthwall (the “Service”).
These Terms of Service constitute a legally binding agreement between you and Creator regarding your use of the Service, your account, and any content or membership benefits provided by Creator.
PLEASE READ THESE TERMS CAREFULLY.
By accessing or using the Service, creating an account, purchasing a Product or Membership, or accessing Creator content, you confirm that you have read, understood, and agreed to be bound by these Terms of Service, our Privacy Policy, our Cancellation and Refund Policy, our Content Warnings, and any additional policies displayed through the Service.
If you do not agree to these Terms or do not meet the eligibility requirements below, you must not access or use the Service.
1. Service Overview
The Service provides an online storefront where visitors may purchase ebooks, digital downloads, artwork, physical merchandise, memberships, and other products made available through the Service.
Products, digital downloads, physical merchandise, and Memberships are collectively referred to as “Products.”
The Service is provided using the Fourthwall platform.
Fourthwall, not Creator, is the seller of all Products and Memberships available through the Service. Purchases are also governed by Fourthwall’s Merchandise Terms of Service, Privacy Policy, and any additional terms presented during checkout.
These Terms govern the relationship between you and Creator concerning your use of the Service and Creator-provided content. Fourthwall is not a party to these Terms.
Although Memberships are sold through Fourthwall, the associated Creator content and advertised Membership benefits are provided by Creator.
2. Eligibility and Adult-Only Content
The Service and Creator content are intended strictly for adults.
You must be at least 18 years old and have reached the age of majority in your jurisdiction to:
Access or use the Service;
Create an account;
Purchase a Product or Membership;
Access books, chapters, artwork, downloads, or Membership content; or
Participate in any community or interactive feature.
By using the Service, you represent and warrant that you meet these requirements and are legally permitted to access adult content in your jurisdiction.
You may not falsify your age or date of birth. We reserve the right to suspend or terminate an account if we reasonably believe that the account holder is underage or has provided false information.
3. Accounts and Registration
You may be required to register for an account to purchase Products or access Membership content.
Accurate Information: You agree to provide accurate, current, and complete information when creating your account and to update that information when necessary.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account.
If you believe your account has been accessed without authorization or is no longer secure, you must contact us promptly at contact@support.shop.athenastarr.ca.
Personal Use: Accounts and Memberships are issued to one person only. You may not sell, share, transfer, or provide your account credentials to another person.
We may suspend or terminate accounts that are shared, compromised, used fraudulently, or operated in violation of these Terms.
4. Products and Memberships
Product descriptions, prices, included files, digital formats, Membership benefits, renewal periods, and other applicable information will be displayed on the relevant product page or during checkout.
You are responsible for reviewing this information before completing a purchase.
Creator may add, remove, replace, revise, or discontinue Products and Membership offerings at any time.
Purchasing a Product or Membership does not transfer ownership of Creator’s intellectual property to you.
5. Pricing and Payment
The applicable price, currency, taxes, shipping fees, and other charges will be displayed before you complete your purchase.
You authorize Fourthwall and its payment processors to charge the total purchase amount, including applicable taxes and fees, to the payment method selected during checkout.
You are responsible for providing accurate billing information and maintaining a valid payment method.
Creator may change Product and Membership prices at any time. Price changes will not apply retroactively to a completed purchase or paid billing period.
Promotional prices, discounts, and special offers may be limited by time, availability, customer eligibility, or other stated conditions.
6. Recurring Memberships
Monthly and yearly Memberships may renew automatically.
By purchasing a recurring Membership, you authorize Fourthwall and its payment processors to charge your selected payment method at the beginning of each billing period until the Membership is cancelled or terminated.
You must cancel your Membership before its next renewal date to avoid being charged for the next billing period.
You may cancel through the Billing section of your account or by contacting us at contact@support.shop.athenastarr.ca.
Cancelling your Membership prevents future renewal charges. Unless otherwise stated or required by applicable law, your access will continue until the end of your current paid billing period.
Creator may revise, replace, add, or remove individual Membership benefits when reasonably necessary. Reasonable notice will be provided when a material change significantly affects an active paid Membership.
7. Membership Cancellations and Refunds
Memberships provide immediate access to digital content, including chapters, stories, artwork, downloads, and other exclusive materials.
All Membership payments are final and non-refundable once processed, except where:
A refund is required by applicable law;
A confirmed duplicate or incorrect charge occurred; or
A refund is otherwise authorized under Fourthwall’s applicable terms or policies.
We do not provide partial or prorated refunds for unused time remaining in a billing period when a Membership is cancelled early.
A dislike of Creator content, a change of mind, failure to use Membership benefits, or failure to cancel before a renewal date does not qualify for a refund, except where required by applicable law.
8. Ebooks and Digital Products
All sales of ebooks, wallpapers, digital artwork, PDF guides, downloadable files, and other digital Products are final and non-refundable once the download link or digital access has been provided, except where required by applicable law or authorized under Fourthwall’s applicable terms or policies.
Refunds will not be issued for:
- Change of mind or buyer’s remorse;
- Accidental purchases;
- Failure to review the Product description;
- Dislike of a storyline, character, trope, ending, or writing style;
- Discomfort with mature content that was reasonably disclosed;
- Failure to download or use a Product after access was successfully provided; or
- Device or application incompatibility when the available file format was disclosed before purchase.
If you receive the wrong file, receive a corrupted file, are charged more than once, or cannot access your purchase, please contact us at contact@support.shop.athenastarr.ca. Where appropriate, the charge may be corrected, the file replaced, or access restored.
Nothing in these Terms limits any refund, cancellation, replacement, or consumer right that cannot legally be excluded.
9. Digital File Compatibility
Digital Products may be provided in formats including EPUB, PDF, JPG, PNG, ZIP, or another format identified on the Product page.
You are responsible for confirming that your device, operating system, or reading application supports the disclosed file format before purchasing.
We do not guarantee that every digital file will function with every device, application, operating system, or third-party service.
Reasonable assistance will be provided when a file is missing, corrupted, incorrectly delivered, or inaccessible because of a verified delivery problem.
10. Physical Products, Shipping, and Returns
Physical Products will be shipped according to the shipping method, cost, estimated delivery period, and other terms displayed during checkout.
You are responsible for providing a complete and accurate shipping address.
Shipping estimates are not guaranteed. Delivery may be delayed by carriers, customs processing, weather, service interruptions, or other circumstances outside Creator’s reasonable control.
International customers are responsible for customs duties, import taxes, handling charges, and other fees imposed by their jurisdiction.
Returns, replacements, cancellations, and refunds for physical Products are administered in accordance with Fourthwall’s Merchandise Terms of Service, the policies displayed during checkout, and applicable law.
Made-to-order Products are not eligible for change-of-mind, sizing, or preference-based returns unless otherwise stated.
If a physical Product arrives damaged, contains a manufacturing or printing defect, or is materially different from the item ordered, contact contact@support.shop.athenastarr.ca and provide your order number and clear photographs of the issue.
11. Intellectual Property Rights
Unless otherwise stated, all original content made available through the Service is owned by or licensed to Creator and is protected by applicable copyright, trademark, and intellectual-property laws.
Protected content includes, without limitation:
- Books, stories, chapters, excerpts, and bonus scenes;
- Characters, fictional worlds, lore, terminology, and world-building;
- Artwork, illustrations, graphics, photographs, and wallpapers;
- Logos, branding, Product designs, and website content;
- Membership posts, downloads, videos, and audio; and
- Other original written, visual, or digital materials.
All rights not expressly granted under these Terms are reserved by Creator or the applicable rights holder.
12. Limited Personal Licence
When you lawfully purchase or access Creator content, Creator grants you a limited, revocable, non-exclusive, non-transferable, and non-sublicensable licence to read, view, download, or use the applicable content solely for your personal and non-commercial use.
Your purchase or Membership does not give you ownership of Creator content or any associated intellectual-property rights.
Except where expressly authorized in writing or permitted by applicable law, you may not:
Copy, reproduce, republish, or distribute Creator content;
Share purchased files or Membership content with another person;
Upload content to file-sharing, piracy, social-media, or public-access websites;
Sell, sublicense, rent, or commercially exploit Creator content;
Modify, adapt, translate, or create derivative works from Creator content;
Remove copyright notices, watermarks, credits, or ownership information;
Circumvent payment systems, access restrictions, or download protections;
Scrape, archive, extract, or systematically collect content from the Service; or
Use Creator content to train, test, develop, populate, or improve an artificial-intelligence or machine-learning system.
Unauthorized reproduction, distribution, account sharing, or piracy may result in immediate account termination and any other remedies available under applicable law.
13. Adult Content and Reader Discretion
Creator’s books and stories may contain explicit sexual content, violence, gore, disturbing themes, morally dark characters, abusive relationships, dubious-consent scenarios, consensual non-consent themes, blood play, supernatural coercion, and other mature subject matter.
Content warnings are provided where reasonably possible. However, no content-warning list can identify every theme, event, or potential trigger.
You are responsible for reviewing the available Product description and content warnings before purchasing or accessing Creator content.
By choosing to purchase or access Creator content, you acknowledge its adult nature and accept responsibility for determining whether it is appropriate for you.
14. User Conduct
You agree to use the Service lawfully and respectfully.
You may not:
Use the Service for an unlawful or fraudulent purpose;
Harass, threaten, stalk, or abuse another person;
Post hate speech, unlawful content, or malicious material;
Impersonate another person or misrepresent your identity;
Falsify your age or date of birth;
Access or attempt to access another person’s account;
Share login credentials or restricted Membership content;
Circumvent payment, security, or access-control systems;
Introduce viruses, malware, spyware, or other harmful code;
Use bots, crawlers, scraping tools, or automated extraction systems;
Interfere with the operation, availability, or security of the Service;
Infringe Creator’s or another party’s intellectual-property rights;
Initiate a knowingly false or fraudulent payment dispute; or
Assist another person in violating these Terms.
We may remove content, restrict access, or suspend or terminate an account when we reasonably believe these Terms have been violated.
15. Reviews, Comments, and Submissions
Where the Service permits reviews, comments, photographs, messages, or other submissions, you remain responsible for the material you submit.
You must not submit content that is unlawful, infringing, defamatory, threatening, deceptive, abusive, or that violates another person’s privacy or intellectual-property rights.
By intentionally submitting content for public display, you grant Creator a non-exclusive, worldwide, royalty-free licence to display, reproduce, and use that submission for the operation and promotion of the Service.
We may moderate or remove submissions that violate these Terms or applicable law.
16. Feedback
If you voluntarily provide suggestions, ideas, corrections, or other feedback concerning the Service or Creator Products, you grant Creator a non-exclusive, worldwide, perpetual, irrevocable, royalty-free right to use that feedback without compensation or attribution.
This section does not transfer ownership of your independently created intellectual property to Creator.
17. Website Availability and Modifications
We aim to keep the Service and purchased content reasonably accessible, but uninterrupted or error-free availability is not guaranteed.
The Service may be temporarily unavailable because of maintenance, updates, security concerns, platform changes, technical failures, third-party outages, or circumstances beyond our reasonable control.
Creator may modify, suspend, or discontinue parts of the Service or individual features at any time.
Where reasonably possible, we will assist in restoring access when a verified technical problem prevents an eligible customer from accessing a purchased digital Product or active Membership.
18. Third-Party Services and Links
The Service relies on Fourthwall and may contain links to or integrations with payment processors, email providers, social-media platforms, shipping carriers, book retailers, and other third-party services.
Your use of a third-party service may be governed by that party’s own terms and privacy policies.
Creator does not own or control third-party services and, except where required by law, is not responsible for their content, availability, security, policies, or practices.
19. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Service and Creator-provided content are provided on an “as is” and “as available” basis.
Creator does not guarantee that:
The Service will always be uninterrupted, secure, or error-free;
Every digital file will be compatible with every device, application, or operating system;
Every third-party service will remain continuously available;
Every error or defect will be corrected immediately; or
A particular book, character, storyline, trope, ending, or other creative choice will meet your personal preferences or expectations.
Nothing in these Terms excludes any warranty, consumer protection, or legal right that cannot lawfully be excluded.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Creator will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from your use of, or inability to use, the Service or Creator-provided content.
This limitation includes losses arising from service interruptions, device incompatibility, third-party services, loss of data, or unauthorized account access caused by a user’s failure to protect their login credentials.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Purchase-related liability involving Products or Memberships sold by Fourthwall is governed by Fourthwall’s applicable Merchandise Terms of Service.
21. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify and hold Creator and Creator’s employees, contractors, agents, affiliates, and representatives harmless from third-party claims, damages, liabilities, losses, and reasonable expenses arising from:
Your unlawful or unauthorized use of the Service;
Your violation of these Terms;
Your infringement of another person’s intellectual-property, privacy, or other legal rights; or
Content or material you submit through the Service.
Creator reserves the right to assume control of the defence of a matter subject to indemnification, and you agree to reasonably cooperate with that defence.
22. Suspension and Termination
Creator may restrict, suspend, or terminate your access to the Service or Creator content when Creator reasonably believes that you have:
Violated these Terms;
- Shared an account or restricted content;
- Engaged in piracy, fraud, harassment, or unlawful activity;
- Attempted to compromise the security of the Service;
- Falsified your age or account information; or
- Created a risk of harm to Creator, Fourthwall, the Service, or another user.
Termination for a serious violation may result in the loss of access to Membership content without a refund, except where otherwise required by applicable law or Fourthwall’s policies.
You may stop using the Service at any time. You may cancel an active Membership through your account billing settings or by contacting contact@support.shop.athenastarr.ca.
Provisions concerning payment obligations, intellectual property, prohibited conduct, disclaimers, limitations of liability, indemnification, and dispute resolution will survive termination where applicable.
23. Electronic Communications
By creating an account, purchasing a Product, or becoming a member, you agree that transactional and administrative communications may be sent to the email address associated with your account.
These communications may concern purchases, downloads, payments, Memberships, renewals, cancellations, security, account access, or policy changes.
Transactional communications are separate from optional promotional newsletters. Marketing messages will be sent in accordance with your communication preferences and applicable law.
You are responsible for keeping the email address associated with your account accurate and current.
24. Changes to These Terms
Creator may revise these Terms to reflect changes to Products, Memberships, business practices, technology, platform requirements, or legal obligations.
The revised Terms will display an updated effective date.
When a change materially affects active members, reasonable notice may be provided through email, an account notification, or a notice displayed through the Service.
Changes will apply prospectively and will not retroactively alter the terms governing a completed purchase unless permitted by law.
Your continued use of the Service after revised Terms take effect constitutes acceptance of those changes.
If you do not agree to the revised Terms, you must stop using the Service and cancel any active Membership before its next renewal.
25. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Subject to any consumer right that cannot legally be restricted, disputes between you and Creator concerning these Terms will be submitted to the courts located in Ontario, Canada.
Product purchases, payment processing, returns, refunds, and other transactions involving Fourthwall may also be governed by Fourthwall’s applicable terms.
Nothing in this section prevents a consumer from relying on mandatory rights or remedies available under the laws applicable to that consumer.
26. International Use
The Service may be accessed from locations outside Canada.
You are responsible for ensuring that your use of the Service and access to adult content comply with the laws applicable in your location.
Access to the Service is prohibited where the Service or its content would be unlawful.
Creator does not represent that all Products or content are appropriate or legally available in every jurisdiction.
27. General Terms
Entire Agreement: These Terms, together with the Privacy Policy, Cancellation and Refund Policy, Content Warnings, and any other policies expressly incorporated into them, constitute the agreement between you and Creator concerning your use of the Service and Creator-provided content.
These Terms do not replace or override Fourthwall’s Merchandise Terms of Service or other terms governing transactions between you and Fourthwall.
Severability: If any provision of these Terms is found invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
No Waiver: Creator’s failure to enforce a provision of these Terms does not waive the right to enforce it later.
Assignment: You may not transfer your rights or obligations under these Terms without Creator’s prior written permission. Creator may transfer these Terms as part of a business transfer, restructuring, or sale, subject to applicable law.
Headings: Section headings are provided for convenience only and do not affect the interpretation of these Terms.
